Another flycatcher problem for me. I saw this guy today. Here's another one and another one I know they aren't good photos but I was wondering what else could it be. It's not an Empidonax. I waited to see if he would call but he didn't. He also perched on dead branches at the top of them and I know this what is common with Olive Sided Flycatchers.

Nice work. Id certainly say Olive-sided Flycatcher. They do like to perch out in more conspicuous branches at the tops of trees while the other species we get here tend to do so much less. The sharp contrast between the belly and sides are really well shown here in your pictures. A true 'vest' if ever was one! The big head and bill, large size and short tail are excellent fieldmarks captured as well. Where did you see this guy? First of the season bird!

I saw him at Jesperson Dyke. He was in the second field from the west gate. I was lucky to get him the first time. I just looked up and he was sitting there at the top of the tree. I took some quick shots and then he flew to another dead tree at the top. Took some more shots and he flew to the other side of the river. Speaking of the river has the water ever came up. I could easily walk on the islands a week ago and now I can barely walk along the shore a couple of feet.
I also though I saw a Townend's Warbler but I am not sure.
I have never seen one before so it's a new life list bird for me. Thanks for your help.
