Are those the same bird? The second one has a tricky perspective and exposure.
The first one looks like a Cooper's hawk based on head shape, small-appearing eye on the face, both giving it an angry look. And the uneven tail feather length points to Cooper's as well.

My apologies, yes, it is the same bird it just moved to a higher location in the same oak tree.
