A really dark-phase Red-tailed Hawk. I thought about Harlan's sub species but the brown tones in the body colouration as well as the fairly red tail seems to say just dark-phase Red-tail.
Mind you, some interesting reading can be found on the variation in tail pattern between Red-tail and Harlan's Hawks.
